Terms & Conditions
By downloading or using the BigBlue and/or VizReport applications (collectively referred to as "the Apps" or "these Apps") on any platform, these terms will automatically apply to you. You should make sure, therefore, that you read them carefully before using the Apps.
If you downloaded the Apps from the Apple App Store, we additionally apply the terms laid out in Apple's standard end-user license agreement. Apple's standard end-user license agreement applies to the iOS versions of both of this company's apps: BigBlue and VizReport. For users on Google Play (Android), these Terms & Conditions constitute the license agreement between you and GeoPelagic LLC.
You are not allowed to copy or modify the Apps, any part of the Apps, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the Apps, and you also shouldn’t try to translate the Apps into other languages or make derivative versions. The Apps themselves, and all the trademarks, copyright, database rights, and other intellectual property rights related to them, belong to GeoPelagic LLC.
Service Modifications and Security
GeoPelagic LLC is committed to ensuring that the Apps are as useful and efficient as possible. For that reason, we reserve the right to make changes to the Apps or to charge for their services, at any time and for any reason.
The BigBlue and VizReport apps store and process personal data that you have provided to us to provide our Service. It’s your responsibility to keep your phone and access to the Apps secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features, and it could mean that the BigBlue or VizReport apps won’t work properly or at all.
Third-Party Services
The Apps use third-party services that declare their own Terms and Conditions. Links to the Terms and Conditions of third-party service providers used by the Apps:
Connectivity and Liability
You should be aware that there are certain things that GeoPelagic LLC will not take responsibility for. Certain functions of the Apps will require the Apps to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but GeoPelagic LLC cannot take responsibility for the Apps not working at full functionality if you don’t have access to Wi-Fi and you don’t have any of your data allowance left.
If you’re using the Apps outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Apps, or other third-party charges. In using the Apps, you’re accepting responsibility for any such charges, including roaming data charges if you use the Apps outside of your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the Apps, please be aware that we assume that you have received permission from the bill payer for using the Apps.
Along the same lines, GeoPelagic LLC cannot always take responsibility for the way you use the Apps; i.e., you need to make sure that your device stays charged. If it runs out of battery and you can’t turn it on to access the Service, GeoPelagic LLC cannot accept responsibility.
With respect to GeoPelagic LLC’s responsibility for your use of the Apps, it’s important to bear in mind that although we endeavor to ensure that they are updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. GeoPelagic LLC accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the Apps.
Navigation Warning and Assumption of Risk
We would like to emphasize that the BigBlue and VizReport apps are not and should never be used as an aid to safe and legal navigation. Only official government charts and notices to mariners contain the information needed for safe and legal navigation. The captain retains all responsibility for safety at sea. Bathymetry and legal boundary data included in the Apps may contain errors. By using the Apps and therefore accepting these terms, the user waives all claims to damages due to inaccuracies of data.
Assumption of Risk: You explicitly acknowledge and agree that offshore fishing and boating are inherently dangerous activities that carry risks of property damage, serious bodily injury, or death. You acknowledge that the BigBlue and VizReport apps are tools for situational awareness only and are not safety devices. You assume all risks associated with the use of these Apps in a maritime environment, including but not limited to battery failure, data inaccuracy, and lack of connectivity.
Subscriptions and Refunds
As part of the Service, GeoPelagic LLC provides paid subscription versions of the BigBlue and VizReport apps, both of which allow users to access more features. While we endeavor to make the Apps as useful and worthy of your payment as possible, if you are dissatisfied with the service, if the service is interrupted, or if the Apps fail, GeoPelagic LLC will not refund your payments. All fees and payments are non-refundable.
Updates and Termination
At some point, we may wish to update the Apps. The Apps are currently available on iOS and Android – the requirements for the systems (and for any additional systems we decide to extend the availability of the Apps to) may change, and you’ll need to download the updates if you want to keep using the Apps. GeoPelagic LLC does not promise that it will always update the Apps so that they are relevant to you and/or work with the operating system version that you have installed on your device. However, you promise to always accept updates to the applications when offered to you. We may also wish to stop providing the Apps, and may terminate use of them at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination: (a) the rights and licenses granted to you in these terms will end; and (b) you must stop using the Apps, and (if needed) delete them from your device.
Disclaimer of Warranties
THE APPS ARE PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, GEOPELAGIC LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITATION TO THE FOREGOING, GEOPELAGIC LLC PROVIDES NO WARRANTY OR UNDERTAKING, AND MAKES NO REPRESENTATION OF ANY KIND THAT THE APPS WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS, OR SERVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS, OR BE ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GEOPELAGIC LLC OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, NEGLIGENCE, AND ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APPS, EVEN IF GEOPELAGIC LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL GEOPELAGIC LLC’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE APPS.
Indemnification
You agree to indemnify, defend, and hold harmless GeoPelagic LLC and its officers, directors, employees, agents, and successors from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to your use or misuse of the Apps or your breach of these Terms and Conditions.
Changes to These Terms and Conditions
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
